What Is Tortfeasor?

A tortfeasor is a person or entity that commits a tort, which is a civil wrong recognized by the law as grounds for a lawsuit.

This term derives from the Latin word "tortum," meaning twisted or wrong, and refers to conduct that causes injury or harm to another, resulting in legal liability for the person who commits the act.

The concept of a tortfeasor is central to tort law, which addresses circumstances where an individual's actions or omissions cause harm or loss to another person.

While the principle of a tortfeasor is most commonly associated with civil law, the concept intersects with other areas of law, including criminal law and business law. For example:

In criminal law, a person who commits a tortious act may also face criminal charges if the act violates criminal statutes.

In business law, companies can be considered tortfeasors if their actions, through their employees or policies, cause harm to individuals. This is often seen in product liability cases.

Common Misconceptions About the Meaning of Tortfeasor

A common misconception is that a tortfeasor must intend to cause harm. While intentional torts do require a specific intent to harm, many torts, such as those based on negligence, do not require intent. Instead, they focus on the breach of a duty of care that results in injury or damage.

Another misunderstanding is that tortfeasors are always individuals. In fact, organizations, corporations, and even government entities can be considered tortfeasors if their actions cause harm to others.

Lastly, there's sometimes confusion between criminal and tort law, leading to the mistaken belief that a tortfeasor must be found guilty in a criminal court to be held liable in civil court. The standards of proof and the objectives of the two systems are different, allowing for civil liability for torts even when criminal charges are not pursued or a defendant is acquitted in criminal court.
