What Is Settlor?

A settlor, also known as a grantor or trustor, is the individual or entity that creates a trust by transferring assets into it for the benefit of trust beneficiaries.

Common Misconceptions About the Meaning of Settlor

One common misconception is that the settlor loses all control and rights over the assets once they are placed in a trust. In the case of a revocable trust, the settlor often retains significant control, including the right to revoke the trust or modify its terms.

Another misunderstanding is that the settlor must be an individual. In reality, entities such as corporations or partnerships can also serve as settlors, especially in the context of employee benefit trusts or charitable foundations.

Lastly, some believe that creating a trust is solely for the purpose of avoiding taxes. While trusts can offer tax advantages, they serve a variety of purposes, including asset protection, estate planning, and supporting charitable goals, reflecting the settlor's diverse intentions and needs.
