What Is Injunctive Relief?

Common Misconceptions About the Meaning of Injunctive Relief

One common misconception is that injunctive relief is easy to obtain or that it can be used to solve any legal dispute.

In reality, courts consider this remedy extraordinary and will only grant it when the plaintiff meets strict legal standards. Another misunderstanding is regarding the scope of injunctive relief; some may believe it only stops actions, but it can also require parties to take specific actions.

Additionally, there's a misconception that an injunction provides immediate relief.

While preliminary injunctions can be issued relatively quickly, obtaining them requires urgent and convincing arguments, and the process may involve several court hearings and extensive legal arguments.

Permanent injunctions, on the other hand, are typically issued as part of a final judgment after a full trial, which can take a considerable amount of time.
