Collateral estoppel, also known as issue preclusion, is a legal doctrine that prevents a party from re-litigating an issue that has already been judged on the merits of a previous lawsuit involving the same parties.
This principle is used to promote judicial efficiency and preserve the finality of judgments by limiting the possibility of inconsistent verdicts in different cases.
For collateral estoppel to apply, the issue previously decided must be identical to the one currently under consideration, and the party against whom the doctrine is being invoked must have had a full and fair opportunity to litigate the issue in the prior case.
Civil Litigation: In civil cases, collateral estoppel can prevent a party from arguing an issue that was already settled in a previous case, such as negligence in a personal injury suit.
Criminal Law: While less common in criminal law, collateral estoppel can apply, for example, to preclude relitigation of facts determined in a defendant's favor in a prior trial.
Administrative Law: It can also be applied in administrative proceedings if an issue has been previously litigated and decided in court.
A common misconception is that collateral estoppel applies to any issue that has been previously discussed in court. However, the doctrine only applies to issues that were actually litigated and essential to the final judgment in the previous case.
Additionally, it's often confused with "res judicata," but while both doctrines aim to prevent litigation of disputes, res judicata applies to claims or causes of action that have been decided, whereas collateral estoppel applies to issues within those claims.
