What Is Challenge for Cause?

A challenge for cause is a formal objection raised by a party in a legal proceeding, typically during jury selection, seeking to disqualify a potential juror. The objection is based on the assertion that the juror is biased, has a conflict of interest, or is otherwise incapable of serving impartially.

Common Misconceptions About the Meaning of Challenge for Cause

A common misconception is that challenges for cause can be used without reason. Unlike peremptory challenges, which can be used without providing a reason (subject to limitations), challenges for cause require specific, articulated grounds for disqualification.

Another misconception is that there is a limit to the number of challenges for cause. There is typically no limit to the number of challenges for cause a party can raise, as long as each challenge is based on valid grounds.

Lasty, some believe that a challenge for cause guarantees a juror's dismissal. The judge has the final say on whether a challenge for cause is valid. If the judge does not find the reasons compelling, the juror will not be dismissed.
