The Term Attorney Work Product in Different Legal Contexts

While the attorney work product doctrine is most closely associated with litigation, its principles can apply in various legal settings where the anticipation of legal disputes influences the creation of documents and materials.

For example, in corporate law, attorneys may prepare analyses regarding potential litigation risks associated with business decisions. Although not part of an active lawsuit, such preparations could be protected under the work product doctrine if litigation were to become a realistic possibility.

Common Misconceptions About the Meaning of Attorney Work Product

One common misconception is that all documents produced by or for attorneys are protected as work products.

In reality, the protection applies specifically to materials prepared in anticipation of litigation. Routine business documents, even those prepared by an attorney, do not automatically receive work product protection unless they relate directly to anticipated or ongoing litigation.

Another misconception is that the attorney work product doctrine makes materials absolutely immune from discovery.

While the doctrine does provide strong protection, especially for materials reflecting an attorney's mental impressions and legal theories, in certain circumstances, courts can order the disclosure of work product materials.

This typically requires showing a substantial need for the materials and that the information cannot be obtained through other means without undue hardship.

Lastly, there's sometimes confusion between attorney-client privilege and work product protection.

While both serve to protect certain communications from disclosure, attorney-client privilege covers confidential communications between an attorney and their client for the purpose of seeking or providing legal advice, regardless of litigation.

Work product protection, however, is more narrowly focused on materials prepared in anticipation of litigation.
